can't decide

whether this is a common European red garden spider( why that would be in NY is a good question- but it really looks like it) or a type of orb weaver - but the colors don't really match anything on the NYS spiders site. It was rather large - about a cm and was happily whizzing around putting the finishing touches on its web.
