Out of focus rose!

As you can see the rise has black spot so very soon I must chop them all off and put them in the garden waste bin! The acer behind will soon be turning but it also looks quite sad as the tips of lots of leaves are dying. Don’t know what it is and whether I can prune it back. Maybe I should just do it and see what happens!
