Flawed – legally and linguistically

I was looking for a subject for mono treatment and found this old gate with its ancient "PRIVATE TRESPASSERS WILL BE PROSECUTED" label or sign.  Firstly, I doubt that only private trespassers would be treated like that; secondly, trespass is not a criminal affair, so prosecution is not possible. It would have to be dealt with by a civil court, where the landowner would have to sue the trespasser. 

I realise that the Government made trespass a criminal offence more than 10 years ago, but that was only for groups of three or more . . .
