Seagull or Penguin?

We're in Dubrovnik now or to be precise Mlini, a beach resort just outside Dubrovnik.
We arrived at 12sh and first impressions of Dubrovnik and Mlini excellent!
I took this seabird pic on the way to the beach next to our latest apartment. Not sure what it is so any help appreciated?
Water still crystal clear but beaches very busy. Not what we've been used to!
Tomorrow plan to explore Dubrovnik either very early or late (to avoid the hordes) depending on the boys.
